TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions (“Agreement”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“Client,” “you”), and JUAN RODULFO DBA RED WASP DRONE (EIN: 92-2560703) (“Company,” “we,” “us,” or “our”), concerning your access to and use of the redwaspdrone.com website and the professional aerial and ground services provided by the Company.

1. SERVICES PROVIDED

Red Wasp Drone provides professional aerial and ground-based photography, videography, mapping, roof inspections, and construction surveying (“Services”). All operations are conducted by FAA Part 107 Certified pilots.

2. PILOT IN COMMAND (PIC) AUTHORITY

Pursuant to FAA regulations, the Remote Pilot in Command (PIC) has final authority over the operation. The PIC may, at their sole discretion, refuse to fly or terminate a flight if conditions are deemed unsafe (e.g., weather, GPS interference, TFRs, or unruly bystanders). Safety is our non-negotiable priority.

3. WEATHER & CANCELLATION POLICY

  • Weather: Drone operations are subject to weather conditions (wind, rain, visibility). If the Company determines the weather is unsuitable for flight, the mission will be rescheduled at no additional cost to the Client.
  • Client Cancellation: Cancellations made by the Client less than 24 hours before the scheduled shoot may be subject to a cancellation fee of 50% of the quoted project price.

4. PERMISSIONS & ACCESS

The Client warrants that they have the legal right to authorize entry and aerial filming of the subject property/location. The Client shall indemnify and hold harmless Red Wasp Drone against all claims, or liability arising from a lack of proper authorization to film a location, person, or property requested by the Client.

5. INTELLECTUAL PROPERTY RIGHTS

  • Ownership: Unless otherwise agreed in writing, Red Wasp Drone retains all copyrights and ownership of raw and unedited footage/data.
  • License: Upon full payment, the Client is granted a non-exclusive, perpetual, royalty-free license to use the final delivered media for the specific purpose intended (e.g., real estate marketing, internal construction review).
  • Portfolio Use: Red Wasp Drone reserves the right to use any captured footage for its own promotional and marketing purposes unless a Non-Disclosure Agreement (NDA) is executed prior to the shoot.

6. MAPPING & SURVEYING DISCLAIMER

Red Wasp Drone provides high-accuracy 2D/3D mapping and construction data via DroneDeploy. However, Red Wasp Drone is not a licensed Professional Land Surveyor (PLS) or Professional Engineer (PE). Our data is for informational and analysis purposes only and should not be used as a legal land survey or for stamped engineering documents unless verified by a licensed professional.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Red Wasp Drone’s total liability for any claim arising out of this Agreement, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the Client for the specific Service in question. Under no circumstances shall Red Wasp Drone be liable for consequential, indirect, or incidental damages (including lost profits).

8. INSURANCE

Red Wasp Drone maintains professional liability and hull insurance through SkyWatch Insurance Services, Inc. Proof of insurance (COI) can be provided upon request for specific commercial projects.

9. COMMUNICATION PROTOCOL & ANTI-SPAM

To maintain security and filter automated solicitations, all first-time telephone inquiries must follow our verification protocol:

  • Text First: You must text 786-277-1213 to verify you are a human before a voice call will be accepted.
  • Automated or “Robo-calls” are strictly prohibited and will be blocked.

10. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts located in Osceola County, Florida.
